Da parecchi giorni senza loro nuove, eccomi a chiederne, desideroso di saperle ottime. Da parte mia ho varie cose a dirle, importanti ed importantissime.

Intanto l'avverto che a giorni il noto atto sarà debitamente registrato, e così ogni cosa sarà in regola. Non ho potuto prima, perché assente l'Avv. Dina , e poi il notajo Strambio , dal quale si doveva avere un altro atto da richiamare in quest'ultimo per il registro. Infine jeri sono tornati tutt'e due e si sono messi d'accordo.

L'altro jeri, entrando al Caffé Cova , mi venne detto che Don Giulio Venino (le indico questo nome per di Lei norma) annunciava ad un redattore del Pungolo  che il M.° Verdi aveva acquistato un terreno fuori Porta Vittoria , per fondare un istituto musicale. Naturalmente il redattore del Pungolo  mi chiese notizie, alla quale richiesta risposi saperne affatto nulla: in seguito a ciò la notizia non fu pubblicata: ma ho creduto bene di avvertirla, perché Ella mi indichi come regolarmi. Il Venino è pure mio amico, ma nulla mi disse in proposito: è celebre per le notizie à sensation, perciò le indicai il suo nome, nel caso Ella possa presumere dove mai andò a pescare tale cannonata.

Noi abbiamo un importante processo coll’editore Benoit  di Parigi , che rilevò alcune proprietà Escudier , fra le quali Trouvère  e Traviata . Le è noto che le nostre cessioni ad Escudier escludevano il diritto di location du matériel sempre riservato alla nostra Casa: Escudier con sotterfugi indecorosi e disonesti, non rispettò i nostri contratti, e ne fece di tutti i colori, noleggiando per conto suo non solo gli spartiti, ma perfino vendendoli. Il Benoit vorrebbe continuare su questa via: chiamato in tribunale, noi abbiamo avuto piena vittoria in 1a istanza: Benoit si è appellato, e noi ci tenevamo sicuri della vittoria anche in appello, quando ad un tratto egli tira fuori una lettera di Verdi , colla quale, a quanto mi dicono, Escudier è autorizzato a fare les locations. Se questo sia vero, o no, non lo so, ma il nostro avvocato di Parigi , Pouillet (una celebrità) teme che ciò ne faccia soccombenti. La faccenda è della massima importanza per noi, e ne riceveressimo [sic] un fiero colpo.

Perciò devo vivamente pregarla di rammentarsi se effettivamente tale lettera fu scritta: se le fu carpita abilmente da Escudier , chissà con quali fandonie, con quali arti subdole, il che forse potrà trovare nelle lettere Escudier . I nostri contratti con Escudier stesso non lasciano dubbi, né ebbe mai diritto di disporre del materiale in modo alcuno: s’intendono, ben inteso, sempre esclusi i droits d’auteur, che nulla hanno a che fare nella presente causa.

Se non si trattasse di cosa della massima importanza, certamente non l'avrei importunato = ma non ho bisogno di aggiungere parole, sia per farle presente tutta la gravità del caso, sia per scusarmi se le arreco tale noja.

In attesa di sua risposta, spero anche sapere che non è molto lontana la loro venuta a Milano , e ciò sarà una vera festa per noi - che aspettiamo ansiosi il vivo piacere di rivederli.

Illustrious Maestro ,

 

   Having no news of you both for several days, here I am seeking what I hope to be a response that you are doing quite well. For my part I have various things to tell you, some of them important and some very important.

   First off, you should know that in a few days the noted act will be duly registered, and then everything will be in order. I was unable to do it earlier because Avv. Dina was absent, and then the notary Strambio , from whom another act which is referenced in this act was needed for the registry. Both men finally returned yesterday and they worked things out between them.

   When I stopped at the Caffé Cova the other day, I was told that Don Giulio Venino (I specifically mention this name so that you are fully informed) announced to a journalist from Il pungolo that M. Verdi had purchased land outside Porta Vittoria to establish a music institute. Naturally, the journalist from Il pungolo asked me for information, to which request I responded that I knew nothing whatsoever. As a result the notice was not published; but I thought it was best to let you know so that you can tell me how to proceed. Venino is even my friend but he said nothing about it; he is famous for spreading news à sensation [gossip], which is why I indicated him by name, in the event you might wonder wherever he would have gone fishing to have landed such a whopper.

   We are amidst important legal proceedings against the publisher Benoit of Paris , who absorbed some of the holdings of Escudier , among them Trouvère and Traviata . You are aware that our licensing agreement to Escudier excluded any location du matériel [rental material] for performance, which is always the domain of our Company; but Escudier , using disreputable and dishonest subterfuge, did not respect our contracts and resorted to all manner of mischief, not only renting the scores on their own but even selling them. Benoit would like to continue these same tactics. When we took him to court, we were awarded a complete victory in first instance. Benoit appealed the sentence and we were sure our victory would be confirmed in appellate court, when all of a sudden he pulled out a letter from Verdi in which, according to what I am told, Escudier is authorized to handle les locations [the rental]. Whether this is true or not I do not know, but our lawyer in Paris , Pouillet (a celebrity in his field) fears that it may be grounds for surrender. The matter is of the greatest importance for us, and it would be a serious blow indeed.

   Therefore I must earnestly beg you to remember if such a letter was actually written, if you were cleverly hoodwinked by Escudier with who knows what nonsense, what devious art, which you might be able to find in your correspondence with him. Our contracts with Escudier leave no room for doubt, nor has he ever had the right to manage this material in any way – with the unequivocal exception of the droits d’auteur, which have nothing to do with the current litigation.

   If this were not so terribly important I certainly would not have bothered you – but I need say nothing more, either to emphasize the seriousness of the case, or to excuse myself for causing you such annoyance.

   In anticipation of your response I also hope to hear that the two of you will come to Milan in the near future, which will be a real treat for us – we anxiously await the enormous pleasure of seeing you again.
