Riteniamo che avrà ricevuto la ns lettera di jeri speditale ai Bagni di Casciano .

Dobbiamo ora informarla che al Registro prima di stabilire la tassa della sentenza si vuole che noi notifichiamo:

1° il valore attribuito ai diritti d’autore delle opere Sonnambula - Lucrezia Borgia - Linda di Chamounix - Maria di Rohan - Ugonotti .

2° il valore come sopra per l’opera I Puritani riconosciuta di proprietà Cottrau .

3° l’importo dei noleggi attribuiti alle opere abusivamente rappresentate da Sonzogno .

4° il valore dei noleggi suddetti dovuti dalla ns Casa alla Ditta Cottrau per le opere in comunione.

Noi non vogliamo fare alcun passo senza averla prima consultata, epperò ci affrettiamo di esporle le nostre idee sui diversi punti suddetti.

Per risponderle al primo quesito noi facciamo la media del reddito di ciascuna opera e per il periodo di tempo che resta a fruire dei diritti di rappresentazione, capitalizzandola poi. Cosicché il valore delle opere suddette verrebbe ad essere calcolato in:

£16.000 _ la Sonnambula

“ 14.000 _ la Lucrezia Borgia

“ 20.000 _ la Linda di Chamounix

“ 3.000 _ la Maria di Rohan

“ 20.000 _ Gli Ugonotti

“ 18.000 _ I Puritani per ciò che riguarda il 2^doquesito.

Ella ben vede da questo specchio quanto ci siamo tenuti moderati e quanto - nel caso che convenisse - si potrebbe razionalmente aumentare il valore di ciascun’opera.

Venendo al terzo quesito, noi crediamo bene di esporle un minimo ed un massimo dei prezzi in uso pei noleggi delle opere suddette e secondo l’importanza dei rispettivi teatri.

Al Manzoni si rappresentano Elisir , Barbiere e Sonnambula . Per ora dobbiamo limitarci al solo nolo di quest’ultima, e pel cui prezzo si può stare dalle £400 alle £600.

Al Costanzi , pei noli Puritani e Sonnambula si potrebbe stare, come anche per la Linda di Chamounix dalle £600 alle £800 ciascuna. Pel nolo Ugonotti dalle £3000 alle 4000.

Alla Fenice a Venezia pel nolo Sonnambula si potrebbe stare dalle £1200 alle £2000 e pel nolo Ugonotti dalle £3000 alle £4000.

A Firenze non si diedero che Barbiere e Guglielmo Tell , pel le quali per ora non non abbiamo nulla da notificare.

Per ciò che riguarda il 4° quesito la proporzione del ricavo noleggi riservata alla Ditta Cottrau , viene calcolata come segue: per l’opera I Puritani , per ogni 100 lire = £53.15 alla Ditta Cottrau e £46.85 a noi, per le altre opere in comunione - pure per ogni 100 lire = £ 42.50 [sic] alla Ditta Cottrau e £ 47.50 [sic] a noi .

Non crediamo che nella valutazione dei noleggi delle opere abusivamente rappresentate da Sonzogno possa calcolarsi il danno arrecatoci sia per il fatto che Sonzogno prese il posto di altri Impresari coi quali la nostra Casa avrebbe concluso affari di grande convenienza, sia per il fatto che per evitare contravvenzioni da parte di altri impresari noi dovemmo per parecchi mesi accordare eccezionali ribassi sui noleggi delle opere in discussione, sia per il fatto che altri impresari dovettero rinunciare a contratti già trattati ed anche conclusi con la ns Casa per spartiti che - essendo stati rappresentati da Sonzogno non poterono venire riprodotti su quegli altri teatri pei quali la ns Casa aveva iniziato o concluso trattative. Riteniamo che tutto ciò fornirà oggetto speciale per la causa dei danni, ma nulladimeno, abbiamo creduto bene di farne cenno, giacchè sembra che al Registro si vogliano dettagli per la valutazione dei dovuti compensi.

Non abbiamo ancora tenuto parola di quanto sopra all’eg° Sig Avv° Gabba dal cui commesso ci venne partecipata la richiesta del Registro. Lo faremo appena che Ella ci avrà favorito una risposta, la quale potrebbe anche essere telegrafica per acquistare tempo. Tutto sommato, visto che la tassa non sarebbe molto forte (crediamo £1.20 per mille) riteniamo che converrebbe stare alquanto alti segnatamente nella dichiarazione del valore delle opere.

We presume that you will have received our letter of yesterday which was sent to you at Bagni di Casciano . Now we must inform you that in order to determine the fine to be levied resulting from the sentence , the Court Registrar requires the following information:

1. the value attributed to the copyright for the operas Sonnambula – Lucrezia Borgia – Linda di Chamounix – Maria di Rohan – Ugonotti .

2. the value as above for the opera I puritani recognized as the property of Cottrau .

3. the amount of income from the rental of those operas unlawfully represented by Sonzogno.

4. the amount of the aforementioned rental income owed by our Company to Cottrau for those operas shared in co-ownership.

We do not want to make any move without consulting you first, but we hasten to present our ideas to you on the various points listed above.

To respond to the first question, we determine the average income of each opera according to how much time we have remaining to exploit its performance rights, then converting the figure into capital. Thus the value of the operas above would be calculated as:

£16,000 – La sonnambula

“14,000 – Lucrezia Borgia

“20,000 – Linda di Chamounix

“ 3,000 – Maria di Rohan

“20,000 – Gli ugonotti

“18,000 – I puritani with regard to the 2^nd question.

You can clearly see from this list how conservative we were and – should it prove convenient – how we could reasonably increase the value of each opera.

As for the third question, we find it best to provide you with our minimum and maximum rental charges for the aforesaid operas, according to the importance of the theatre.

At the Manzoni they have programmed Elisir , Barbiere , and Sonnambula . Only the last of these is relevant here, for which the rental charge would be between £400 and £600.

At the Costanzi , the rental of Puritani , Sonnambula , and Linda di Chamounix would be between £600 and £800 each. For the rental of Ugonotti , between £3000 and £4000.

At La Fenice in Venice , rental of Sonnambula would be between £1200 and £2000, and rental of Ugonotti between £3000 and £4000.

In Florence they performed only Barbiere and Guglielmo Tell , so that for now we have nothing to report.

With regard to the 4^th question, the proportion of rental charges allocated to the Ditta Cottrau is calculated as follows: for the opera I puritani , for every 100 lire = £53.15 goes to Cottrau and £46.85 to us; for the other operas in co-ownership, always for every 100 lire = £42.50 [52.50?] to Cottrau and £47.50 to us .

We do not believe that the damage we sustained for the operas unlawfully represented by Sonzogno can be calculated in this estimate of rental charges, first of all because Sonzogno took the place of other impresari with whom our Company would have concluded business that was greatly advantageous for us; second, because to prevent violations by other impresari we were forced for many months to agree to exceptionally reduced rental charges for the operas being discussed; and third, because still other impresari have had to rescind contracts already negotiated and even concluded with our Company for the rental of scores that – having been represented by Sonzogno – could not be used in those other theatres for which our Company had begun or concluded negotiations. We believe that all this is especially pertinent to our litigation for damages, but even so we have thought it best to only mention it here, since it seems that the Registrar wants details for an estimate of the compensation we are owed.

We have not yet addressed any of this to Sig. Avv. Gabba , whose clerk informed us of the Registrar’s request. We will do so as soon as you are kind enough to respond, even by telegram to save time. All things considered, given that the fine would not be very steep (probably £1.20 per thousand), we feel that it would be better to aim rather decidedly high in declaring the value of the operas.
