Non è al direttore del “Corriere della Sera” ch’io mi rivolgo, bensì a quel gentiluomo della cui integrità nessuno può eccepire - a questo sottopongo il caso seguente, fidando nella di lui imparzialità.

Nell’interesse dei diritti di proprietà che io rappresento, in seguito alle voci corse che il Corpo Musicale di Pianella (come del resto fu pubblicato in un giornale del paese) avesse eseguito una fantasia sull’Otello di Verdi, ho creduto utile e doveroso di intentare causa. Il Corriere di qualche giorno fa portava nientemeno un telegramma apposito, come si trattasse di causa di grande importanza, e redatto in modo da recare danno grave, anzi gravissimo alla nostra Ditta, poiché se abbastanza esatto nelle conclusioni, sottaceva i motivati della Sentenza = pel che ne potrebbe derivare la credenza essere permesse le trascrizioni e le relative esecuzioni di opere sulle quali vige la riserva di proprietà. Colla grande diffusione che ha il Corriere, lascio a Lei il valutare a quali conseguenze sarebbe esposta la ns. ditta, e gli innumerevoli processi che dovrebbe incoare.

Quantunque avvertito telegraficamente dell’esito e della sostanza della sentenza, non volli fare passo alcuno fino a che la sentenza stessa non mi fosse pervenuta, come avvenne oggi stesso. Orbene in detta sentenza vi si afferma in modo tassativo i riservi della esecuzione pubblica: vi è riconosciuto che le voci che correvano autorizzavano la denuncia e l’accusa = e che infine il Maestro della banda di Pianella non venne assolto per inesistenza di reato, ma solo per insufficienza di prove di reità.

Come Ella vede, eg° Signore, le cose sono ben diverse, e simil sentenza, anziché danneggiare, conferma i diritti di proprietà. Per conto mio pare strano che, dopo la voce pubblica corsa con tanta insistenza, dopo una notizia data da un giornale, si trovi ora a sette mesi di distanza una partitura che non con[tiene] altro che due battute dell’Otello…. tosto abbandonata!...il Maestro è un portento!!... o ha gabbato il pubblico allora…. o ci [ha] gabbati noi ora. Ma queste sono mie induzioni personali: il meglio che possa fare, è di accludere la Sentenza, e chiedere alla di lei cortesia che si compiaccia leggerla.

Ella è troppo acuto giudice per non valutare immediatamente e il danno arrecato colla notizia pubblicata, e la sostanziale differenza che esiste fra la portata della notizia stessa, e ciò che effettivamente dice il giudicato. Ella ha troppa equità per permettere ch’io (intendo come rappresentante la ditta) debba sottostare ad un danno tanto grave: io ho piena fiducia, eg° Signore, nella di Lei saggezza, e sono certo troverà modo, in quella forma dignitosa propria al di Lei giornale, e senza neppure rettificare il telegramma del di Lei corrispondente, di far conoscere il vero spirito della sentenza emanata in Firenze: ed è con questa fiducia ch’io mi pregio fin d’ora ringraziarla vivamente, dichiarandomi gratissimo per quanto stimerà opportuno di fare, mentre coi sensi di stima distinta ho l’onore di ripetermi

   It is not the director of the Corriere della sera whom I am about to address, but rather a certain gentleman I know to be of unquestionable integrity: to him I submit the following situation, trusting in his impartiality.

   In protecting the ownership rights that I represent, after having heard rumors (which for that matter were printed in the local paper) that the Corpo Musicale di Pianella had performed a fantasia based on Verdi’s Otello, I found it fitting and proper to sue. Some days ago the Corriere published nothing less than a telegram concerning this specifically, as if the case were of enormous importance, and worded in a manner to cause serious, indeed very serious damage to our Company because, while its conclusions were substantially correct, it failed to state the motivations of the Sentence – which means one could logically deduce that it was deemed legal to make transcriptions of works under copyright and to perform them. Given the wide distribution the Corriere enjoys, I leave it to you to consider the consequences our company would face, and the countless lawsuits that it would be forced to bring to court.

   Although I had been notified via telegram of the conclusion and the substance of the sentence, I did not want to proceed further until I had received the sentence itself, which arrived today. Now, this sentence decisively confirms our rights for public performance: it established that the rumors were legitimate reason to make the denunciation and accusation, and that in the end the Maestro of the band of Pianella was absolved not because no misdemeanor was possible, but because there was insufficient proof that it had been committed.

   As you can see, dear Signore, things are quite different, and such a sentence, rather than damage us, confirms our claim of copyright. For my part I find it strange that, after the rumors had spread with such insistence, and after a notice in a newspaper, a score now surfaces seven months later with nothing more than two bars of Otello…. which was immediately abandoned!... the Maestro is quite a wonder!!... either he fooled the public at the time…. or he has fooled us now. But these are my personal deductions; the best thing to do is to enclose the Sentence and ask that you have the kindness to read it.

   You are too perceptive a judge not to immediately understand what harm this notice has done to us, and the substantial difference that exists between the inference of the notice itself and what the sentence actually said. You possess too great a sense of justice to allow me (understood as representing the company) to endure such serious damage: I trust completely, dear Signore, in your wisdom, and I am certain you will find a way befitting the dignity of your newspaper, and without even rectifying the telegram sent by your correspondent, to inform your readers of the true spirit of the sentence handed down in Florence. In this spirit of trust may I thank you warmly in advance, declaring my utmost gratitude for what you will determine most opportune to do, and with my best regards I am honored to remain
